This page provides information on the ‘Terms and Conditions’ on which you use and on which we sell our products to you via this site. All the information provided below and any other information to which the below information refer, will be collectively described as ‘Terms and Conditions’.

Please note that by using either the whole or any separate part of this site, and/or by placing an order for products from this site, you agree to these ‘Terms and Conditions’. If you do not agree to these ‘Terms and Conditions’, please do not use this site.

Information About Us

This site is operated by HOUSE OF MYRTLE Branch of Foreign Company, a company registered in Greece with General Commercial Registry Number 135855201001 and VAT number GR997182582, trading as ‘House of Myrtle’ and houseofmyrtle.com (collectively “we”, “us”, “our”). Our registered office address is 42 Roumelis St, 15233 Halandri, Athens, Greece.

All sales of products made through this site are subject to these ‘Terms and Conditions’.

Placing Orders and Contract Creation

The steps for placing an order on the site and for forming a contract with us are as follows:

You will be guided through the ordering process by a series of instructions on the site. You place your order at the end of this process by clicking on the “COMPLETE ORDER” button. You can review/amend your order at any time before clicking on the “COMPLETE ORDER” button.

Unfortunately orders cannot be amended once they have been placed.

As soon as you place your order, we will send to you an Order Confirmation e-mail  detailing the products you have ordered. This is not an acceptance of your order by us. Your order is an offer to buy a product or products from us and is subject to acceptance by us. If we do not or cannot accept your order, for any reason, we will notify you.

When your order is shipped from us, we will send you a Dispatch Confirmation e-mail , which will confirm that we have accepted your order. The Contract is formed between you and us when you receive the Dispatch Confirmation e-mail and concerns only the product(s) included in this e-mail. Any products on the same order which have not been confirmed in the Dispatch Confirmation e-mail do not form part of that Contract. No product will be shipped until full payment has been made.

General

The Contract between us for products sold via the site will be concluded in English.

The contract formed between us constitutes the whole agreement between us and supersedes all prior agreements, arrangements and understandings between us relating to the same subject matter.

In case any of these ‘Terms and Conditions’ or any part of the contract is held by any court or other competent authority to be invalid or unenforceable in whole or in part, the remaining terms and provisions of the contract shall continue to be valid.

Product Availability

The products featured on the site are in stock, unless otherwise stated, e.g. sold-out, coming soon. We do our best to keep our site updated at all times regarding the available stock for each product. However, if any items of your order turn out to be unavailable, we will reimburse to you the amount paid for this product as soon as possible.

Please note that until you have completed your order, all products in your shopping bag are still considered as part of our stock and could, therefore, be purchased by another customer.

Pricing, Taxes and Payment

VAT is included in all prices quoted on the site. Delivery costs, detailed in our Deliveries Information section, are added to the total cost of the order during the order process, but before you click on the “COMPLETE ORDER ” button.

If the delivery address is within the EU then you should not be charged with any additional duties or taxes. If the delivery address is in a non EU country then your shipment may be subject to additional taxes, duties or customs clearance charges. We cannot estimate these costs and we are not responsible for their payment.

We accept the following payment methods:

• Debit Cards
• PayPal
• Cash on Delivery (ONLY for deliveries within Greece)

Cash on Delivery is a service that we offer for deliveries all around Greece at a standard cost of 3.00 euro.

All debit and credit card payment transactions are performed through PayPal’s electronic payment platform. By clicking “COMPLETE ORDER” you warrant that the debit or credit card is yours and that you are at least 18 years old.

Please note that if your card issuer fails to authorize payment to us, we will are not responsible for any delays or non-performance.

Delivery

Please see ‘Delivery Information’ for delivery costs by destination and delivery type.

Please note that any changes you make to your account after placing an order will not take effect immediately and won’t apply to orders already placed.

We aim to deliver your ordered products by the estimated date set out in the Dispatch Confirmation e-mail , or, if no date is given, at the latest within 30 days of the date of the Dispatch Confirmation e-mail .

The delivery date is calculated from the date of dispatch. All estimated delivery times are to be used as a guide. We are not responsible for late deliveries due to circumstances outside of our control. We will inform you of any unexpected delay.

If you are not at the delivery location at the time agreed and we are unable to deliver, the Courier representative will leave you a note with contact details as proof of the parcel’s arrival. Contact with the Courier Customer Service will be required to arrange a mutually convenient time, date and place to deliver the parcel. However, you may be charged for the storage and redelivery of the product(s).

Please note that if the product(s) is/are not delivered within 30 days of the dispatch confirmation e-mail, you are entitled to cancel the order and be refunded any amounts paid by you for that order. Please see our Delivery and Returns Policy for more information on your right to cancel.

Ownership of and risk in the products you have ordered will pass to you at the time they are delivered to you.

Cancellations, Returns & Exchanges

Please read our Delivery and Returns Policy which details how to return unwanted or unsuitable items for a refund or exchange.

In addition to our general returns policy for unwanted products, consumers have a 14 day period in which to cancel their contract with us and receive a full refund.

If you decide to return the product(s) to us for a refund or exchange in accordance with our Delivery and Returns Policy, risk will remain with you until we have received the returned products.

Promotional Codes

Unless otherwise expressly stated in the ‘Terms and Conditions’ for a particular promotional code, promotional codes cannot be combined and cannot be used in conjunction with any other offer/discount. If you have more than one promotional code and the codes cannot be combined, it is up to you to use the promotional code that has the biggest benefit to you.

Intellectual Property

Unless otherwise noted, all images, photography and product related text are subject to copyrights and/or other intellectual property rights that are owned by House of Myrtle. All such rights are reserved.

Our site, and its content, is intended solely for the personal, non-commercial use by users of our site. Any use of our  site and its content for purposes other than personal and non-commercial is prohibited without the prior written permission of House of Myrtle.

Third Party Links

Websites featured on our site as a third party or affiliated party have separate privacy policies and data collection practices from us. Therefore, we have no responsibility or liability for these policies and practices or the content of such websites. These linked websites are only for your convenience and therefore you access them at your own risk.

Moreover, we do not undertake responsibility for any information or advice obtained by you from any websites featured on our site.

Governing Law

These ‘Terms and Conditions’, and any dispute or claim arising out of or in connection with these ‘Terms and Conditions’, shall be governed by Greek law, which follows EU legislation. Any dispute arising from, or related to, these ‘Terms and Conditions’ and such Contracts shall be subject to the non-exclusive jurisdiction of the courts of Athens, Greece.

Warranties and Disclaimers

Unless specific warranties are expressly given when you purchase products from our site, we do not give any warranties or guarantees in respect of such products over and above those implied by applicable law. However, we remain responsible for supplying products that conform to the contract.

Limitation Of Liability

Nothing in these ‘Terms and Conditions’ limits your statutory rights if you are contracting with us as a consumer, including your right to a replacement or repair where products supplied are not of satisfactory quality at the time of delivery to you and before any use by you.

The material displayed on this site is provided without any guarantees, conditions or warranties as to its accuracy. Unless expressly stated to the contrary, to the fullest extent permitted by law, House of Myrtle excludes all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity. House of Myrtle shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this site or the Third Party Links and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise. This does not affect House of Myrtle’s liability for death or personal injury arising from its negligence, nor for fraudulent misrepresentation, misrepresentation as to a fundamental matter or any other liability which cannot be excluded or limited under applicable law.
